The law has strengthened the obligations and penalties for companies and managers
GDPR, Sapin 2, the penalties are serious:
Financial penalties by the Anti-Corruption French Agency against managers for up to EUR 200 000 for natural persons and up to EUR 1 000 000 for legal persons for failure to comply with the Sapin 2 rules; in addition, in case of financial crime, criminal penalties of up to 10 years’ imprisonment and EUR 1 000 000 in fines (or up to double the proceeds of the offence).
Administrative fines by the CNIL reaching up to EUR 20 000 000 or up to 4% of the total worldwide turnover of the previous financial year (whichever is the higher) for breaches of the GDPR.
